your probably right on harassment! i hope not but probably. the big question is....do you think the money has already been spent and everyone is just now seeing the fabricated paper trail? it sounds that way to me.

I think the money is over inflated.  Read the whole thread, same guy, same study, 15k three years ago.  Now/   250k.   That is the tip.  A screwing of $10m plus is coming our way.  Trying to wade through tax code, etc to figure it all out. 

The real deal appears to be the structure of the bond - appears to be a ploy to circumvent a general obligation bond by issuance of a PAB or revenue bond with no revenue.   A general obligation bond requires a vote.  The others?  Nope.  So, way to circumvent the folks who get to pay for it.

i did, he did raise his price, that's why i wondered if the money had already changed hands cause the only way that gets by is if there is someone on the inside as in " the good ole boy" system which is why i wouldn't be surprised. it's great your bringing it to light. yes a 10m screwing is coming if more don't get behind demanding an explanation or opposing this.

To me ,it would seem that the "leaders" of Payson are way under the pay level required to sort these things out for themselves and likely have no clue as to what any of the contract truly means. I know that I would be way under qualified to even make an informed opinion if I were one of the town leaders and would have to ask for a LOT of expertise to help me . I would not be too embarrassed to ask for help but most "leaders" egos prevent that. Is that possibly the case here?

Sort of. 

Their egos drive their goals, they find folks smart enough to make it happen.  Double Barrel Muni is a sly way to do it.  That took some brains.  Took me a about 40 hours to figure it out.  It is all legal.  Smart, very smart.

About 20 years ago we had a city manager that did just this sort of thing. We ended up with a grandiose football stadium and an"aquatic" center. Both cost well over twice what they should have and both are financial disasters. The stadium was finally given to our local college so we didn't have to continue paying for it's maintenance. Where do we think the college gets it's funding for maintenance> from the property taxes that just mysteriously went up about double at the same time. All legal and a raping of the taxpayers that had absolutely no say in any of it.

I requested the emails in support of the 25k spent.  Doubt I will get them.  I suspect I get to twaddle off to the court house for a more formal approach.  Or, maybe some good State agency can help me?   The local Tea Party and Libertarian folks have taken some interest in the issue.  I suspect the upcoming railroad planning meetings will be a bit more interesting now....

Busy week. Two presentations by Mr. Chambless.  Working on a "jargon translator."   My take away?  They are willing to say whatever it takes to gain support.  Mr. Chambless indicated the prep school is now K-12, because everybody wants to send a kindergartner to "prep school." 

As an example, Mr. Chambless uses the phrase "Private bond placement" a lot.  A quick thought on “Private Capital” or "Private Bond Placement."  The issue is not the “placement.”  The issue is the guarantor.  All bonds are “placed privately” via underwriters, syndicates, etc.   The issue to zero in on is who is the guarantor?  I.e. – who is on the hook?  Not just first debtor, but second and third?  These guys are great with semantics.  Me, not so much.  ;)

Subsequent to that article, KMOG has been in contact with us.  Currently, it appears we are "conjecture."  KMOG is requesting we wait for "facts."  Their station, their rules.  They have requested additional information via email.  Here is a snip.

THE START
The plan is 600 elite prep hockey students and new rec center at no cost to the town. 

THE PLAYERS
CCP is owned by Lee Polozaja, various dealings including the defunct ammo plant.  Formed in July 2017.

Varxity was crowd funded in 2014, has no assets I can find and no history of actually being more than a concept.  They also have no current legal standing in Arizona that I can find.  The sole employee is a school principal in Edmonton.

SOME DECEIT?
After the deal was announced, CCP invoiced the city for work from June 21st to Sept 21st.  Neat trick for a company that was not in business until July.  I have requested email support of that invoice, to date none has been received.  Also requested response from CFO of town, to date none.

CCP has repeatedly indicated a 10 month process with Gilbert?  Gilbert is unaware of that as is AZ Ice

MONEY
This deal, as most, revolves around financing.  So, it is important to have a basic understanding of a revenue bond.  That is a bond guaranteed via future revenue of a district.  Think Pine Strawberry water and their recent $8m.  Cool, straight up bond.  A general obligation bond requires a vote.  A revenue bond does not.  There is a hi-bred that requires no town vote.  Only approval by the council like a revenue bond.  CCP is on record as saying no vote. 

A Combination Bond is a municipal bond with the coupon and principal guaranteed both by the general revenue of the municipality issuing the bond and by the revenue of the project the bond finances. If the revenue from the project is less than expected and is not enough to make payments, the municipality will make them instead. This appears to be a “General Bond” work around.  There is no apparent requirement for a General Election vote for issuance of a “Revenue Bond” with a backstop of general revenue. 

The verbiage has transformed in the process, today's Roundup calls it a “Revenue Bond.”

THE CONTRACT WITH VARXITY / CCP / PAYSON
In a nut shell, the contract ignores the Town’s procurement policy.  There is nothing that allows a $250k contract on a “tri party” basis.  There are lots of other issues with it.  Like what?  Dubious jurisdiction, significant concessions to Varxity on a no bid basis to include a concessionaire agreement, etc.

IS VARXITY VIABLE?
In a word – NO.  Not at the level they discuss.  There are various “Elite Prep Hockey Schools” in Canada.  Most are under 100 students, 35 to 50k in tuition.  None, not a one I can find, at 600 students.  Most have a ten year ramp up to the 80 student level.  That is important because it changes the stated revenue of $30m to $3.5m  (600 *50k vs 80*35k)

THE COST
The closest like scale project I can find, excluding pool, was $27m C.  That works out to $21.5m US, pool, etc., we are looking at $30m.

We started a committee to circulate two initiatives to prevent this crap.  Drafted text, all of that.  Likely will have to seek an injunction to prevent town action until the ballot measure is resolved.  Meeting with Dems, Libs, Repubs, T Party, NRA, Tree Huggers, Senior Groups, Friends of Library, Pot Heads, any group that we can go to as we are going for the "Transparency" aspect and there is no moral objection to "Transparency."  My schedule is pretty full and there are multiple folks scheduling my time. 

In the meantime I am public enemy number one in various circles.  Some folks like me, others just wish I would go away.  A lot like dating, only different.

So the town does not like me.  Local radio is suggesting I am plotting to usurp the Mayor and overthrow the town.  I am what you would call a "Free Radical."   Yesterday Town Legal had a letter hand delivered via the Constable.  Always a good time when guys with guns pay you an official visit ordered by the court.  They were pleasant enough. 

On the bright side, we have the attention of Judicial Watch and Congressman Gosar is lending a hand.  He can be a polarizing guy at the National Level.  Pretty well a staright shooter, no BS sort of guy.     So, we have the support of the Feds.  Expecting a letter from the USDA / Forest Service soon enough.  Nope, not mid level.  Dickwhacker; level.  The Town may just take me seriously at that point? 

We have 1150 signatures of a required 1400 to place the deal on a ballot.

Elsewhere? Well, a very nice touch was to have the package delivered by the Constable's office. They were very pleasant gentlemen.  But, sending court officers with guns to deliver a letter seems somehow over the top?  Maybe it was to intimidate?  I don't know; we spoke of Jeeps, etc.  Really now, how intimidating is a Jeep?

Now, in the Town's defense, they did send a certified letter. I saw the notice just before the Constable called.  I am often times out of town, so did not see the notice in the mail box right away.  I picked up the letter the next day.

Mr. Figueroa was kind enough to admonish me regarding quorum and possible violation of open meeting laws.  Mr. Figueroa also discusses "TRANSPARENCY."  He notes that "You and your organization take pride on the notion of TRANSPARENCY.  Town Clerk Silvia Smith expects and deserves the same treatment via the notion of TRANSPARENCY."

Parenthetically I note the letter was on 260Chat letter head, nothing to do with Transparent Payson.  Details man. Details. 

I wonder if the County or the Courts know that the constables are running errands? 

The part on 260 vs. Transparent Payson is "Transparent Payson" is a 527 committee.  We have limited purview to advocate much more than the initiatives.

Well, the town has been playing hardball with record's requests.  No worries.  They did pony up some, that surprise! shows they lied about the others. 

So we keep playing. 

In the meantime, every political candidate for local office is taking credit for "Transparent Payson" and them that oppose us look like fools. 

I went ahead and pulled a packet for council.  Have folks collecting signatures for that. 

Likely the initiatives will make the ballot.    My campaign, ehh....  who knows?

So, quick update.  Got the notice certified via County Recorder, Town Clerk and Secretary of State.  Both ballot initiatives will be placed on local ballot.

The Town Attorney is getting high blood pressure from dealing with my attorney on the various records requests.  He is of course free to seek an injunction to stop my political speech.   5:

It should be an interesting local election.  It is pretty cool to actually get it on the ballot.  Democracy and all first hand against a system that really wants no part of it.   :nw

We were successful in placing and passing the two initiatives.  My campaign for a council seat was not successful.  I am a loser baby. 

No worries, I am good with what we did do.  I made a greater impact than any single seat ever  could.   Our guy for Mayor won.  So all is well.

Great your efforts were successful. Even your personal loss was successful in a sense. Honestly ,you are lucky you didn't get elected. Now you can continue to keep your eyes on them and not have to kiss any butt while doing so just to get re-elected.
