Wow!  This is one of those things that gets everyone up in arms.  I can see the illegals not liking a gun pointed at them.  And I fully believe that this guy is doing a great service to this country.  I wonder how many border patrol guys can say they have thwarted over 12,000 attempts to reach the Land of the Free.  He has spent tens of thousands of dollars planting sensors to help him reduce the flow of illegals into this country. 

The lawsuit is going to come down to whether or not those immigrants had civil rights.  Reading the Preamble of the Declaration of Independence, leads me to beleive that they did. 

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."

If they are endowed by their Creator, with those unalienable rights, then who are we to take them away?  It doesn't say, citizens of the USA are endowed by their government, with certain unalienable rights. 

Common sense would say that these people were not only breaking the law by jumping the border, but also tresspassing.  I know what I would do to tresspassers that I caught on my land, hold 'em til the authorities showed up.  Unfortunately, common sense doesn't apply to law and court.  Obviously this guy is a Great American, and I hope those Illegals don't get one cent.  $32 million would be an abomination.

Why the hell did this even make it to court. Those effers shouldhave been sent home before anyone even had a chance to see if their feelings were hurt. Whats the difference between him and the border patroll stopping him. Sounds like citizens arrest to me. Too bad they dont have a volunteer border patroll that he could join so he had the "legal" jurisdiction to stop them. Illegals have more rights than we do, it makes me sick to see a puke of an American defending them. If they loose they should send that POS lawyer defending them to Mexico also.

He should have pulled the trigger.  Then the gov could send him a credit for 12,000 rounds.  Would be a lot cheaper than taking care of all those illegals for the rest of their lives.  I think they waive their rights by crossing the border illegally and they should know the risks.  If we started shooting illegals on site, less of them would take the risk.

What we do now is like catching an intruder in your house, baking them cookies and then giving them a ride home.  Where's the deterent in that?

He needs a MUCH more powerful electric fence, not for the cows for the illegals.  Fried upon contact.  No problem w/ foreigner, just do the paper work, obey the law, get a job, speak ENGLISH, and pay your taxes.  Otherwise get the fook out.

Yeah but he broke our laws too.  Assault is against the law.  Is the jury supposed to turn a blind eye to justice, because these weren't real people he assaulted?  Even if one wants to make the absurd argument that the immigrants don't have human/civil rights, then we still have laws against cruelty to animals.  Hell, you can be charged with a felony in Utah for beating your dog (in public). ;)

I saw something on TV last night that just makes me want to scream.  They have a predator drone patroling the southern border......  I saw this shit before a year or two ago.  Them dumbfxxks spend millions to patrol the border with a freaking predator drone, but will do nothing about the ones they know just came across.  I bet in 1 day I could locate 100 illegal aliens that they have no interest in sending back.  So why spend the money keeping a drone out there?  Mabey they are just counting.  ???

Actually - NO.  He was found negligent not guilty.  Negligence is a civil issue not a criminal one - think OJ's two trials.  When it comes time for negligence arguments the burden of proof is lowered to a "Preponderance."  That is 51%.  Even on a bad day, most plaintiff attorney's can get a negligence verdict if someone has been even slightly "wronged."  Held at gun point can be viewed as such. 

The kicker here in my mind is the way in which the verdict and damages are structured.  "Punitive damages" are non insurable.  That is, the 60k is what he is on the hook for.  His general liability carrier likely picked up the tab for the defense as some of the allegations would have been covered - ie: the assault, but the 60K?  He is on the hook for that personally.  Likely means he has to liquidate assets and possibly sell his ranch - my guess is he is ready to leave it anyway. 

Sad that he has been made a victim of the government's inability to protect it's own boarders.

They were breaking the law, caught while in the act. Then presumably tired to leave. Then the US citizen did his civic duty and detained them until the authorities arrived. The should have no rights in that situation. So we see some one beating the crap out of someone, we should do nothing. Shot the f*#K#@& it's cheaper.

This morning I saw a video on yahoo about a guy that heard people breaking into his house and stealing his stuff.  He snuck out the back and drove off in the burgler's car as he was calling the police.  The dispatch told him to stop, and that he was commiting a crime, WTF?  Anyways, the cops gave him a pass and still haven't caught the bad guys.
